Club Waiver and Code of Conduct

Membership in the Toronto Bicycle Club (TBC) is conditional upon compliance with the Club’s (TBC) procedures and the Code of Conduct as stated below:

Release, Waiver and Assumption of Risk

I hereby acknowledge and agree that in consideration of being permitted to participate in cycling programs, day excursions, multi-day excursions, races or activities organized, operated or sanctioned by the Toronto Bicycle Club (herein called the Club):

I do hereby release the Club, its members, officers, directors, employees, independent contractors, agents, affiliated clubs and associations, and volunteers from all liability, recourse, proceedings, claims, and causes of action of any kind whatsoever, in respect of all personal injuries or property losses which I may suffer arising out of or connected with my preparation for, or participation in, the aforesaid cycling programs, day excursions, multi-day excursions, races or activities, notwithstanding that such injuries or losses may have been caused solely or partly by the negligence of the Club, or any of its members, officers, directors, employees, independent contractors, agents, affiliated clubs and associations, and volunteers.

And, I hereby acknowledge and agree that:

a) the sport of cycling is very dangerous, exposing participants to many risks and hazards, some of which are inherent in the very nature of the sport itself, others which result from human error and negligence on the part of the persons involved in preparing, organizing and staging cycling programs, races and other activities;

b) as a result of the aforesaid risks and hazards, I as a participant may suffer serious personal injury, even death, as well as property loss;

c) some of the aforesaid risks and hazards are foreseeable, but others are not;

d) I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my preparation for, and participation in the aforesaid cycling programs, day excursions, multi-day excursions, races and activities shall be entirely at my own risk;

e) I understand that neither the Club nor any of its members, officers, directors, employees, independent contractors, agents, affiliated clubs or associations, or volunteers assume any responsibility whatsoever for my safety during the course of my preparation for or participation in the aforesaid cycling programs, day excursions, multi-day excursions, races and activities;

f) I have carefully read this RELEASE, WAIVER, AND ASSUMPTION OF RISK agreement, that I fully understand same, and that I am freely and voluntarily executing same;

g) I understand clearly that by signing this release I will be forever prevented from suing or otherwise claiming against the Club, its members, officers, directors, employees, independent contractors, agents, affiliated clubs or associations, or volunteers for any loss or damage connected with any property loss or personal injury that I may sustain while participating in or preparing for any of the above mentioned cycling programs, day excursions, multi-day excursions, races or activities whether or not such loss or injury is caused solely or partly by the negligence of the Club or any of its members, officers, directors, employees, independent contractors, agents, affiliated clubs or associations, or volunteers;

h) I have been given the opportunity and have been encouraged to seek independent legal advice prior to signing this agreement and it is strongly suggested that I obtain insurance coverage for medical, personal injury and trip cancellation;

i) I understand clearly that the Club would not permit me to participate in any such cycling programs, day excursions, multi-day excursions, races and activities unless I signed this RELEASE, WAIVER, AND ASSUMPTION OF RISK AGREEMENT, that this RELEASE, WAIVER AND ASSUMPTION OF RISK agreement applies to all the aforesaid cycling programs, day excursions, multi-day excursions, races and activities whether occurring in the near or distant future, and that the terms of this Agreement need not be brought to my attention each time I participate in a cycling program, day excursions, multi-day excursions, race or activity in order to be effective;

j) the term cycling programs, day excursions, multi-day excursions, races and/or activities as used in this RELEASE, WAIVER, AND ASSUMPTION OF RISK agreement includes without limiting the generality of that term, the National Team programs, races and activities as well as all other races, training sessions, clinics, programs and events that are in any way authorized, sanctioned, organized or operated by the Club or any affiliated Associations or any of them;

k) this RELEASE, WAIVER, AND ASSUMPTION OF RISK agreement is binding on myself, my heirs, my executors, administrators, personal representatives and assigns; and

l) photo’s, video’s, etc, taken of me while participating in Toronto Bicycle Club activities may be used on social media or other promotional materials conditional to the TBC Social Media Policy.

TBC Code of Conduct

1. I confirm that I am 21 years of age or older.
2. The culture of the club is a friendly, social, positive, fun and supportive community. I will contribute to the cited culture. 
3. I will be polite, respectful and friendly to all TBC members.
4. I agree to pay all outstanding fees in full prior to receiving a membership or to remain a member.
5. The TBC is a non-profit volunteer club. Volunteers are essential for the success of the TBC. I will respect their expectations when I participate on a ride, activity, social event and/or trip.
6. TBC e-mails are for members only. They are not to be shared/forwarded to non-members and former members.
7. I agree not to register as a member using someone else’s name or by using a pseudo name. Please feel free to include a preferred first name on your application.
8. If I am asked/informed to leave the TBC via e-mail, letter and/or in person I cannot attend any TBC activities, rides, trips or social events.
9. I will abide by the trip policies in regards to cancellation procedures, sign-up procedures and payment procedures.
10. I will communicate my concerns to the executive in a professional manner.
11. I will not send negative e-mails/communicate electronically to TBC members about other members.
12. I will adhere to the club’s road safety policy as stated in the handbook.
13. I agree that I must wear my CSA approved helmet when riding with the Club. I will ensure that my bicycle is equipped with a night light and flashing reflector light, which I agree to use when riding under low light conditions or in weather conditions that limit my visibility to traffic.
14. I will ride a bicycle that is in good condition. That is, the bicycle will have good: tires, brakes, gears, handle bars, rims, forks and frame.
15. Once approved as a TBC member, I shall have all Club privileges subject to any restrictions, which may be imposed by the Executive.

I understand that being deemed an official member of the TBC for the current season is based on approval by the executive. TBC is a private club in which membership is deemed to be a privilege. If a member does not abide by the code of conduct his/her membership can be immediately terminated as determined by the executive. A member or potential member’s membership can be refused, revoked or restricted as determined by the executive. The Executive’s decisions are final and are not subject to appeal. I understand that my membership is not official unless I acknowledge agreement to the code of conduct via my signature and signed by a witness. Our goal is to ensure that all members feel safe and enjoy themselves during club activities.
